The term ‘Visit Asia Pvt. Ltd. ‘ or ‘us’ or ‘we’ refers to the owner of the website whose registered office is Manali. Our company registration number is. The term ‘you’ refers to the user or viewer of our website.

As part of our effort to provide you hassle-free, enjoyable holiday the ‘Terms and Conditions’ below is our contract with you to prevent misunderstandings between the tour escorts/facilitators, the company and you at any time in the course of the travel. Please spare us some of your valuable time. We require you to read and ACCEPT all the terms and conditions, before you contract our services.

 

Information Validity and Accuracy

The information our website and company brochures have been published in April 2014, replacing All previous information.


Definitions

“Passenger(s)/You/Guest/client” means the person/persons in whose name/on whose behalf booking or registration is made. “Company/We/Us” means Visit Asia Pvt. Ltd.
“Tour escorts/facilitators” means tour guides, independent contractors including hoteliers, transports representatives or any other person or organization who has been selected by the company to render services to the Passenger(s).


Jurisdiction

All disputes if any pertaining to the (tour and travel), travel-related services, adventure activities conducted by the Company, and any refund/ claim arising there-under shall be subjected to Shimla, H.P., India jurisdiction only.


Scope of Activity

We are travel and holiday organizers only. We do not provide insurance services. We also do not process claims of any kind. All adventure activities are risky sports, involvement in such activities is guest(s) own choice / risk and we do not take any responsibility for mishaps or accidents. We do not accept any claim.


Accommodation and Transport

Hotels/Room. Accommodation provided is generally on a twin sharing bases so single occupancy, arising for whatever reason, will cost more. Extra bed will also be charges as per hotel specified rates. Guests will have to abide by the check-in/out time of the respective hotels. Early arrivals/late departures or overstays due for whatever reason is the responsibility of the guests themselves. Use of hotel services and amenities are the responsibility of the guests.


Meals. There is a pre-set menu for meals as per the tour program. We reserve the right to change the meal arrangements if circumstances demand us to do so. A tour participant missing a meal for whatever reason can not the meal missed.


Transport. Our cars are allotted on the booking priority basis. Each transport operators have their own set of rules that must be complied. The company is not liable to any dispute arising from non-compliance of such rules. Any damages caused by you during the travel shall be payable by you.


Safety and Health Matters. All baggage and personal effects shall be at all times and in all circumstances, the responsibility of passengers.Visit Asia Pvt. Ltd. is not responsible for any type of loss and damage (baggage or person). Health matters should be the sole responsibility of the traveler. Adequate travel insurance cover is strongly recommended. It shall be duty of the guest to inform the Company of any medical condition(s) that may affect his ability to undertake the activities or could negatively affect the interest of the group. Under such situation, the Company reserves the right to deny the guest participation in some of the activities with no refund.


Itinerary Changes. Sometimes we may make amendments to the itinerary, due to unforeseen developments such as unavailability of sights, adverse climatic conditions etc. In some cases such changes could mean extra charges but you will be informed of the complete details. In the event of the Company exercising its rights to amend any aspect of the services, the guest(s) shall have to continue with the program as amended.


Payments. The amount paid at the time of booking, is non-refundable. We do not accept any form of cheques. The bookings will be processed only after 25% of the total amount has been paid. The full amount must be paid fifteen days before the tour/stay starts. We will send a reminder of full payment 20 days before the tour/stay starts. Failure to deliver complete payment will result in cancellation of the arrangement. For instant bookings or on-the-spot booking, 100% payment is required before bookings are processed.


All customers are requested to make the payments as per contract for seamless services.

Travel Documents. It is the sole responsibility of the guest(s) to collect in time and hold valid travel documents and statutory clearances, such as passports, visas, confirmed air/rail tickets, insurance and medical insurance certificates, any other document used to confirm an arrangement with service provider and other statutory certificates, to enable him/her to travel on tour. It is the guest(s) responsibility to collect in time, the necessary travel documents or other documents from the booking office. Essential travel documents must be in the hands of the Owner at all times, and be ready in case of checks by local authorities.
All customers are requested to submit their UID(Aadhar) front and back before receiving the final confirmation via mail.
Personal documents are non-transferable. The company will not accept request for help in replacing lost documents. If in the course of the tour, a guest(s) is refused entry by authorities due to missing personal document, the guest can not claim compensation from the company.


Privacy of Information. We treat all information furnished by you as confidential and will exercise extreme discretion in using the information. However, we may be constrained to disclose the information furnished by you, if such disclosure is required by law or by an order of the court or the rules, regulations & enquiry by any govt./statutory agency having regulatory authority over the Company. The company also reserves the right to publish the guests’ photograph or group’s photograph taken during the tour.
Guest’s acceptance and/or signature on the booking form shall mean complete acceptance of the ‘Terms and Conditions’ contained herein by the guest(s). In case of one person is acting in behalf of the other members of the Group signing the ‘I ACCEPT’, it shall be deemed that the others have duly authorized the concerned signing person. The signing person has to write down the names of the members under his name.


Cancellation Policy For International Tour

Reservation, Deposit and Payment


Full Payment is required in order to guarantee or reconfirm the booking and must be made as per the given date on the invoice generated.Time limit to reconfirm the booking will be given as per the payment policy of the hotel if included in the package or else it will be 10 days prior to arrival for land arrangement.
For purchase of Air, Cruises, Ferry, Coach, Train and Admission tickets only, full payment is required (Unless respective provider T&C allows)
All groups are subjected to a minimum group size (determined by the Company) in order for the departure to be finalized.
For Group packages – full payment is required not less than 14 days prior to departure. If full payment is not received 14 days or more prior to departure, the Company reserves the right to forfeit the deposit and cancel the reservation. In this instance, the cancellation fee as stated below is payable by the Customer.

*The above cancellation charges apply if the air ticket is not issued. If the air ticket is issued, the air ticket value will be added onto the cancellation charges.

* Depending on the hotel policy as for particular dates once the hotel booked it is non cancellable incurring full Hotel payment amount as cancellation charges

*+For cancellation due to major event declared by WHO as epidemic or pandemic or warning by MFA against non-essential travel. The Company will wherever possible assist to provide documents for any travel insurance claims. For Group packages, an admin fee will be charged on top of the third party suppliers (e.g. airlines, hotels etc.) charges.

 

Payment Delay Policy


You have to pay your complete remaining payment according to the payment policy 

1.If the remaining pending payment is delayed by one day then 10% delay charges will be applicable to the total package amount.

2.If the remaining payment is delayed by two days then 15% delay charges will be applicable to the total package amount.

3.If payment is delayed by three or more days then the company has the right to terminate your tour without any prior notice.

4.Failure to deliver complete payment will result in the cancellation of the arrangement.

Cancellation by the Company

Even after deposit or full payment has been made, all arrangements are still subject to final confirmation if for some unforeseeable circumstance the arrangement cannot be finalised and the reservation has to be cancelled, the Company endeavor to notify the Customers at least one weekbefore departure.

Group packages are subjected to a minimum group size in order to depart. If the minimum passenger number is not met, the Company may choose to cancel the tour 14 days prior to departure or offer alternative tours based on current tour fare. Should the Customer decide not to accept the alternatives, all refund will be made accordingly by the Company and without further obligations.

 

Amendment by the Company

The Company makes reasonable effort to avoid changes in the itinerary. However, the Company reserves the right to alter itineraries, travel arrangements, hotel reservations changes at any time (without prior notice and compensation) due to unforeseen circumstances.

 

Extension/Deviation of Stay

An extension/ deviation of stay at the end of the tour or travel arrangement is permitted subject to the maximum validity, availability and restrictions of the air ticket and availability of accommodation prior to the commencement of the tour. The extra costs incurred to process the extension will be borne by Customer. It is the Customer’s responsibility to hold a confirmed seat for the return flight. When extension/ deviation requested cannot be confirmed 3 weeks prior to group departure, the Customer is deemed to return on the original flight/tour schedule booked and no cancellation of tour is allowed. Extensions / deviations of stay / transfer will be at Customer’s own expense. Air ticket issued is restricted to a specified airline only. It is not negotiable, endorsable, re-issuable, refundable or re-routable. Any alteration of the routing or the date by the Customer is solely at the Customer’s risk. The Company and its associated agents shall not be held responsible for any inconvenience caused and extra expense incurred. No refund will be made for any unused air ticket, accommodation, meals or sightseeing, in part or in full.

 

Travel Documents, Travel Insurance

Passport and Other Travel Documents
It is the Customer’s sole responsibility to ensure that he/she has a valid passport with minimum 6 months’ validity from the date of the return point. Relevant visa and vaccinations may be required. For Singapore permanent residents, please bring along your exist permits when traveling. For foreign passport holders, it is the Customer’s responsibility to hold valid re-entry visas.

Travel Insurance
Purchase of travel insurance is strongly recommended with respect to unforeseen circumstances such as trip cancellation, personal baggage loss, personal accident, injury, illness and insolvency. Under no circumstances shall the Company to be construed as a carrier under contract for safe carriage of the Customer or his/her baggage/ belongings. The Company will be pleased to assist in the enquiries of any travel insurance and related matters. Purchasing of insurance can also be done on the Company website

 

General Matters Relating to Tours

Accommodation
Accommodation is as specified in the itinerary or the booking form. Accommodation for adults is based on twin-share, double or triple share bedrooms at the nominated or similar standard hotels. In the event the accommodation booked or requested is not available, every effort will be made for alternative in another accommodation of similar standard. For farm-stays & ski-resorts, sharing of bathroom facilities may be necessary. When booking triple-share rooms, please note that the third bed will be a “roll -away” bed.

Meals
All meals are as specifed in the itinerary. If selected carrier’s fight timing does not allow for certain meals to be taken, there shall not be any refund for meals not consumed. (if any)

Seats Rotation
The Customer is requested to rotate seating arrangement on the coach during the period of the tour.

Special Request
Any special requests such as special meals, dietary requirements, adjoining rooms etc., please inform the Company upon booking. Such requests are subject to confirmation and availability.

 

Confidentiality

The Company will not divulge the Customer’s personal information to any unauthorized third party without any written consent.

 

Responsibility and Liability

All arrangements for the provision of transport, accommodation, sightseeing and other tour or travel services are made by the Company through our appointed agents. The Company accepts no responsibilities for mechanical breakdown, injuries, damage, accident, loss, delay, theft, quarantine, custom regulation, strike, acts of god, and changes in itinerary, deportation or refusal of entry by Immigration or other circumstances beyond its control.

The Company is an agent of airlines, transport companies etc., and is not liable for changes made by suppliers but will render assistance wherever possible.

Authorities resulting from improper travel documents, possession of unlawful items or irregularities that may cause to person or property. Any losses & expenses are the responsibility of the Customer. All proper travel documents (e.g. health certificates, visa and passports) are the sole responsibility of the Customer.

The Company also reserves the right to require any individual to withdraw from the tour if it is deemed that his or her behavior or conduct is detrimental to or incompatible with the health, safety, interests, harmony and welfare of the other tour participants and the tour group as a whole. Under such circumstances, the Company shall be under no liability thereafter to any such person.

No tour leaders/guides, employees or agents of the Company are authorized to commit the Company to any liability whatsoever and the Company will not be bound by any statements or representation unless it is in writing and signed by a management executive of the Company.

The Company also reserves the right to take photographs and films of the Customer while on tour with the Company to be used for marketing materials. Such materials will be used in publications and other forms of advertising.

The Company shall not be liable to the Customer for any goods purchased by the Customer during the tour whether or not the goods are of defective quality, not suitable for the Customer’s purpose, not in conformity with samples provided to the Customer or rejected by the Customer for any other reason whatsoever notwithstanding that the goods are purchased in shops the visitation of which comprise part of the tour package (including itinerary) or which are specifically recommended by the travel services, their guides, servants, employees or independent contractors, nor the Company or the travel services be liable to the Customer for the purchase monies of the aforesaid goods.

Itineraries, prices, services and conditions are correct as the time of reservation. The Company reserves the right to revise the tour fares and to determine the date of commencement of such revised tour

COVID-19 RELATED TERMS & CONDITIONS

User agrees that due to recent outbreak of COVID-19 pandemic, which has been declared as a national disaster by the Government of India, there may be instances, where the end service provider either cancels the booking or refuses to provide the services, as agreed with the User, by assigning or not assigning any specific reason for such refusal. Refusal of service may be due to the reasons including but not limited to the User:

exhibiting any symptoms associated with COVID 19.
· refusing to comply with safety advisories, like wearing protective gear, complying with social distancing norms etc.
· suffering of any ailment making the User vulnerable to the virus
· posing a threat to the health and safety of others


In such cases Visit Asia Pvt. Ltd. will assume no liability for the refusal of service by the end service provider. The User also agrees that refund, if any, for such bookings will be processed by Visit Asia Pvt. Ltd. to the User subject to receipt of the same from the end service provider.

User further understands that due to the outbreak of COVID-19, the Central Government through its ministries, State Governments and statutory bodies have/may come up with detailed set of guidelines or standard operating procedure (SOP) that a traveller will have to follow in order to undertake the travel.

The User agrees to abide with all such guidelines/SOP while undertaking any travel. Failure to abide by such detailed set of guidelines/SOP, may lead to a situation where the service provider or any person authorized by the Central Government, State Government or statutory body may disallow the User to undertake the travel. In such circumstances, Visit Asia Pvt.Ltd. will not be held liable for such refusal to travel and refund, if any, shall be strictly as per the terms of the service provider.

User understands that the Central Government, State Governments and various other bodies, may mandate downloading of Arogya Setu App or submitting a self- declaration form prior to entering a transit point like airport, railway station etc. or at the time of checking-in for a flight, into a hotel etc. Accordingly, the User must ensure downloading of Arogya Setu App on their Smartphone’s or provide any other alternate such as self-declaration when demanded.

User undertakes that all bookings are subject to certain minimum medical well-being criteria specified by the Govt. / appropriate authority from time to time. User should have no medical history of the COVID-19 virus 28 days before the date of scheduled travel, especially in case of inbound travel. In this regard the User may be required to furnish a medical proof or health declaration in a applicable format.
